JUSTICE ASHUTOSH KUMAR ORAL ORDER 21-12-2018 The petitioners seek bail in anticipation of their arrest in connection with Araria P.S. Case No. 159 of 2018 dated 25.03.2018 instituted for the offences under Sections 143, 341, 323, 324, 448, 380, 354, 504, 506, 34 of the Indian Penal Code.

The allegation against the petitioners is of abusing and assaulting the informant and his other family members and divesting them of their personal belongings. The learned counsel for the petitioners has submitted that there is a counter version of the occurrence as well. The injuries suffered by the victims are stated to be simple in nature.

Patna High Court Cr.Misc. No.72814 of 2018(2) dt.21-12-2018 2/2 Regard being had to the facts that petitioners do not have criminal antecedents and one of the similarly situated accused persons has been granted anticipatory bail vide order dated 04.09.2018 passed in Cr. Misc. No. 50974 of 2018, the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(ten thousands) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Araria P.S. Case No. 159 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
