The petitioner, who is in custody since 19.05.2020, seeks bail in connection with Chapra Town P.S. Case No. 277 of 2020, dated 17.05.2020, instituted for the offences under Sections 30(a) and 41(i) and (ii) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
Patna High Court CR. MISC. No.21766 of 2020(2) dt.08-07-2020 2/2 It appears that from a vehicle in which two of the accused persons were sitting, 280 litres of liquor was recovered. In the aforesaid vehicle, a mobile phone also was found. The SIM card in the mobile phone is registered in the name of the petitioner. Perhaps, that is the reason for implication of the petitioner in the present case. It has been submitted on behalf of the petitioner that there is no recovery from the possession of the petitioner and he is a person of clean antecedent. Regard being had to the aforesaid facts, the petitioner above-named is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Addl. Sessions Judge-CumSpecial Judge (Excise), Chapra, District-Saran in connection with Chapra Town P.S. Case No. 277 of 2020.
The application stands allowed.
