The sole petitioner, who is in custody since 09.05.2016, as stated in paragraph-7 of the petition having clean antecedent, in Bhagalpur Railway P.S. Case No. 39/2016 registered for the offence under Section 401, 414 of the Indian Penal Code, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that no stolen article was recovered from the possession of the petitioner. However, on accusation of recovery of two mobiles, the petitioner has been taken in custody. Keeping in view the nature of accusation, period of
