The petitioner is accused in connection with Majorganj P.S. Case No. 52 of 2015 registered under Sections 363, 366(A)/34 of the Indian Penal Code pending in the Court of Additional District Judge 1st, Sitamarhi.

Learned counsel for the petitioner submits that he is married person having three children. He has been made accused on the statement of victim under Section 164 Cr.P.C and has no criminal antecedent.

Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner with submission that there is sufficient material against the petitioner. Para 57 of the Case diary shows that the petitioner was active participant in kidnapping of

Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected. However, petitioner may renew his prayer for bail after framing of charge.
