The petitioner seeks regular bail in connection with Paharkatta P.S. Case No. 12 of 2015, registered for the offence punishable under Sections 147, 148, 149, 323, 341, 307, 353, 325, 427, 337 and 338 of the Indian Penal Code. The allegation is regarding a mob of about 1000 persons having assembled at the police station and engaged in rioting. About 46 persons have been named as accused persons including the petitioner herein.

The learned counsel for the petitioner submits that there is no allegation of any specific overt act as far as the petitioner is concerned and the petitioner is having a clean antecedent. It is submitted that the petitioner has been falsely

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Kishanganj in connection with Paharkatta P.S.
