The petitioner is accused in connection with Guraru P.S. Case No. 46 of 2016 registered under sections 302/201/34 of the I.P.C. pending in the Court of C.J.M., Gaya. The allegation is of killing the deceased by the petitioner and his second wife and thereafter, they cremated the dead body.
Learned counsel appearing on behalf of the petitioner submits that there is no eye witness of the alleged occurrence. Further submission is that petitioner is in custody since 25.10.2016, having no criminal antecedent.

Patna High Court Cr.Misc. No.1681 of 2017 (3) dt.27-02-2017 2/2 opposed the prayer of the petitioner with submission that there is sufficient material against the petitioner in the case diary. Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected.
