JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 25-07-2017 Heard learned counsel for the petitioners, learned counsel appearing on behalf of informant and the learned A.P.P. for the State. The petitioners apprehend their arrest in connection with Murliganj P.S. Case no. 18 of 2017, registered under Section 366(A)/34 of the Indian Penal Code.

The accusation is that on 16.01.2017, in the morning, when informant Vijay Kumar Singh and his wife woke up then found that his two daughters, namely, Chandani Singh and Khusi Singh missing from his house. On enquiry, Bimal Prasad Singh, father of the informant, disclosed that in the night a Scorpio vehicle was seen moving on the road. Thereafter, on 20.01.2017, in course of search, Nilam Devi and Lalita Devi divulged that one Scorpio vehicle, which registration number belongs to Punjab, was seen at the door of the petitioners in which two unknown girls were also seen by them.

No.17165 of 2017 (4) dt.25-07-2017 2/2 Learned counsel for the petitioner submits that in course of investigation, the I.O recorded the statement of Nilam Devi and Lalita Devi, but both showed their ignorance and stated that they did not know either the informant or his daughters. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhepura in connection with Murliganj P.S. Case No. 18 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
