JUSTICE SATYAVRAT VERMA ORAL ORDER 26-11-2021 Heard the learned Advocate for the petitioner and the learned APP for the State through video conferencing. The petitioner seeks bail in connection with Gwalpara P. S. Case No.07 of 2021, instituted for the offences under Sections 25(1-b)a, 26, 35 of the Arms Act. The learned counsel for the petitioner submits that the petitioner is in custody since 06.01.2021, charge-sheet has been submitted in this case and he has one antecedent as mentioned in Para-3 of the bail petition.

The learned counsel for the petitioner further submits that from perusal of the allegation as alleged in the F.I.R., it would manifest that the informant alleges that from

Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case. The recovery was not from his possession and he was made to sign on a blank paper and when he refused then he came to be implicated in the present case.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody since 06.01.2021, charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Uda-Kishunganj, Madhepura in connection with Gwalpara P. S. Case No.07 of 2021, subject to condition that one of the bailors shall be the brother of the petitioner and the petitioner will mark his attendance in the concerned police station on 15th of every month commencing from December, 2021, till the charges are not framed.
