====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 05-12-2018 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Kotwali (Tilkamanjhi) P.S. Case No. 491 of 2018 instituted for the offence under Sections 379 and 411 of the Indian Penal Code. In the written report it is alleged that while the informant was going to her home putting bag on her back, a boy took out her mobile phone from the bag. On her shouting, the people apprehended the boy but he gave mobile to some other person who fled away. The apprehended person disclosed his name as Md. Guddu (petitioner).

Counsel for the petitioner submits that petitioner was apprehended on spot. There is no recovery of any Mobile from

Patna High Court Cr.Misc. No.72082 of 2018(2) dt.05-12-2018 2/2 his possession.

Petitioner is in custody since 28.7.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Kotwali (Tilkamanjhi) P.S. Case No. 491 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
