JUSTICE SATYAVRAT VERMA ORAL ORDER 26-11-2021 The present petition has been taken up for consideration through the mode of Video Conferencing in view of the prevailing situation on account of Covid 19 pandemic, requiring social distancing.

Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Buniyadganj P.S. Case No. 141 of 2020 instituted for the offence under Section 392 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is in custody since 20.12.2020, charge-sheet has been submitted in the case and is a person with clean antecedent. Learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the F.I.R. it would

Learned counsel for the petitioner submits that F.I.R. is against unknown and the name of this petitioner transpired in the confessional statement of Rajesh Kumar who has been granted bail by the learnt court below.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner and submits that though it has come in the impugned order that Rajesh Kumar has been granted bail but the said order has not been annexed with this petition.

Considering the fact that the petitioner is in custody since 20.12.2020, co-accused Rajesh Kumar on whose confessional statement the name of the petitioner transpired has been granted bail by learned court below, charge-sheet has been submitted in the case and the petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in
