The Petitioner apprehends his arrest in a case instituted for the offence under Section(s) 147, 149, 323, 307, 504 Indian Penal Code.

It has been submitted by the counsel for the Informant that six persons were injured and remained in hospital for about ten days and there is specific allegation against the Petitioner of having caused injury to one of the injured and hence, he should not be released on anticipatory bail. Considering that there is counter version of the occurrence and the dispute took place on account of land and there is no other case of similar nature pending against him, it is ordered

Patna High Court Cr.Misc. No.45377 of 2015 (2) dt.14-10-2015 2/3 that in the event of surrender/arrest of the Petitioner, named above, within four weeks from the date of receipt/production of a copy of this order in connection with Raxaul P.S. Case No.145 of 2015, he shall be released on anticipatory bail on furnishing bail bond of `5,000/- (five thousand) with two sureties of the like amount each or any other surety to be fixed by the court below to the satisfaction of the Sub-Divisional Judicial Magistrate, Raxaul at Motihari, East Champaran, subject to the conditions as laid down under Section 438(2) Cr. P. C. and (i) That one of the bailors will be a close relative of the Petitioner, who will give an affidavit giving genealogy as to how he is related with the Petitioner.

Patna High Court Cr.Misc. No.45377 of 2015 (2) dt.14-10-2015 3/3 Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
