The petitioner seeks bail in Sidhawaliya P.S. Case No. 155 of 2017 registered under Section 395 of the Indian Penal Code.

The informant alleged that he was going to deposit money in the bank but in the meantime, six persons came on three motorcycles and snatched his motorcycle and money. The learned counsel for the petitioner submits that petitioner is not named in the F.I.R. The name of the petitioner surfaced in the case in the confessional statement of one Anil Singh. Anil Singh in his confessional statement disclosed the name of 22 persons but no role is assigned to the petitioner in the confessional statement. The informant himself alleged that six persons committed dacoity but Anil Singh disclosed the

Learned A.P.P. did not dispute the fact.

Considering the fact that the name of the petitioner figured in the case in the confessional statement of co-accused Anil Singh who has already been enlarged on bail and petitioner is in jail since 16.01.2020 but he has not been put on T.I.P. as yet, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Gopalganj in connection with Sidhawaliya P.S. Case No. 155 of 2017.
