Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 6.8.2018 passed in Cr. Misc. No.41496 of 2018.
Submission of the learned counsel for the petitioner is that later on one of the co-accused has been granted bail by a Co-ordinate Bench of this Court, vide order dated 26.10.2018 passed in Cr. Misc. no.64542 of 2018 and due to that fact he has filed this application for anticipatory bail of the petitioner. .
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant
Patna High Court Cr.Misc. No.72124 of 2018(2) dt.12-12-2018 2/2 privilege of bail to the petitioner, however, if the petitioner surrenders within a period of four weeks from the date of receipt of the prayer and makes prayer for regular bail, the same shall be considered by the learned court below on its own merit. With the aforesaid observation, this application is dismissed.
