JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-07-2025 Heard learned counsel appearing on behalf of the petitioners learned APP appearing on behalf of the State and learned counsel appearing on behalf of the informant.
2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 126(2), 115(2), 118(2), 110, 303(2), 352, 351(2) and 3(5) of the B.N.S..
3. As per prosecution case, informant, namely Amit Singh, alleged that on 22.10.2024 at about 4:40 PM, he received a ransom call demanding Rs. 1,00,000/- and threatening to kill him. It is further alleged that fearing his life, informant sent Rs. 50,000/- to both these petitioners through his uncle. Thereafter, on 24.11.2024, all the F.I.R. named accused persons, including
Patna High Court CR. MISC. No.20780 of 2025(5) dt.22-07-2025 2/3 these petitioners, attacked informant and attempted to strangulate him and demanded another Rs. 50,000/- as ransom.
4. It is submitted by learned counsel appearing on behalf of the petitioners that petitioners are quite innocent and have committed no offence. The present case is counter-blast of Nautan P.S. Case No. 267 of 2024 which was lodged by petitioner's side. The informant is Mukhiya of Panchayat and taking advantage of his approach lodged this false and concocted case.

On the other hand, learned A.P.P. for the State and learned counsel appearing on behalf of the informant have vehemently opposed the prayer for grant of anticipatory bail to the petitioners and submitted that petitioners are named in the F.I.R. with specific accusation of demanding ransom and attempting to strangulate the informant. It is further submitted that as per Paragraph No. 3 of the bail petition, petitioners have four criminal antecedents each and petitioners have deliberately concealed and suppressed the fact that they are also accused in Prashant Vihar (Delhi) P.S. Case No. 604 of 2021 for committing theft of a car which was recovered pursuant to confessional statement of these petitioners.
6. Considering the facts and circumstances of the
Patna High Court CR. MISC. No.20780 of 2025(5) dt.22-07-2025 3/3 case, nature of accusation, criminal antecedents and conduct of the petitioners, the prayer for grant of anticipatory bail to the petitioners is rejected.
