JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-01-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 448, 354A and 354B of the Indian Penal Code.
It is alleged that the informant was sleeping on the roof of her house, in the meantime, the accused persons arrived at there and started teasing and tried to outrage the modesty by tying her legs and hands, in the meantime, her husband arrived there then accused persons escaped from the scene.
It is submitted by learned counsel for the petitioners that on conclusion of the investigation, the petitioners were not sent up for trial but differing the final form, cognizance has been taken and at earlier point of time, Anita Devi filed Chewara P.S. Case No. 17 of 2014 levelling accusation under Sections 341, 323, 504
Patna High Court Cr.Misc. No.2683 of 2015 (2) dt.21-01-2015 2/2 and 354/34 of the IPC against the husband of the informant and since the petitioners were the sympathizer of Anita Devi, they have been roped in the present case. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Sheikhpura in connection with Chewara P.S. Case No. 18 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
