The petitioner seeks bail in Mushrigharari P.S. Case No. 80/2018, instituted for offences under Sections 115, 399, 402 and 120(B) of the Indian Penal Code read with Sections 25(1-b)A, 26 and 35 of Arms Act.
It is alleged in the written report that the informant along with other police personnel headed by S.D.P.O., Sadar raided the house of Dinesh Sharma situated at village Morva. On seeing the police party, accused persons started running away but the police arrested five persons including the petitioner. On search one loaded country made pistol and five cartridges along with cash were recovered from possession of

Learned counsel for the petitioner has submitted that petitioner has clean antecedent. He is in custody since 24.06.2018.
Keeping in view the clean antecedent and period of custody of the petitioner, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Samastipur in connection with Mushrigharari P.S. Case No. 80/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
