JUSTICE SANJAY PRIYA ORAL ORDER 23-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Raj Nagar P.S. Case No. 202 of 2014 instituted for the offence under sections 409 and 420 of the Indian Penal Code. There is allegation against this petitioner that he misappropriated an amount of Rs. 14000/- which was given to him in advance for distribution of money among the pension holder. It has been submitted on behalf of the petitioner that the amount in question has been deposited by him on 27.6.2015 in the Nazarat for which he has filed a receipt as Annexure-2. This fact finds mention in the impugned order passed by Additional District and Sessions Judge-V, Madhubani.

It has been submitted on behalf of this petitioner that

Patna High Court Cr.Misc. No.12246 of 2017 (2) dt.23-03-2017 2/2 due to illness of wife of the petitioner, the money was not deposited by him within time but on 27.6.2015 the money was deposited by the petitioner.

Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner named above, within six weeks from today, in connection with Raj Nagar P.S. Case No. 202/2014, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhubani, subject to the conditions as laid down under Section 438(2) Cr.P.C.
