JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-04-2017 The petitioner is apprehending his arrest in connection with Paroo P.S. Case No. 26 of 2002 registered for offences punishable under Sections 364, 302, 201/34 of the Indian Penal Code.

The petitioner is not named in the FIR and as a matter of fact the charge sheet was submitted against co-accused Maulvi Mian and investigation against other co-accused persons is going on. Later on, police started torturing and this petitioner moved for anticipatory bail. It is also submitted that the petitioner is an old person aged 85 years.

Heard learned A.P.P.

Learned A.P.P. opposed the prayer for anticipatory bail and submitted that the case was lodged in the year 2002. Having considered the facts and circumstances and

No.17723 of 2017 (2) dt.25-04-2017 2/2 the submission as made above, let the petitioner surrender before the court below and make prayer for regular bail which will be considered material when warrant has been issued against the petitioner there was any execution of the warrant or not and considering this aspect of the matter, learned court below will pass order at least considering the age of the petitioner. Accordingly, this petition is disposed off.
