The petitioner apprehends his arrest in connection with Araria P. S. Case No. 308 of 2015 instituted under Sections 341, 323, 379, 504 and 506/34 of the Indian Penal Code and Section 138 of the Negotiable Instrument Act. The allegation, in brief, is that the informant, being a petty contractor of the petitioner, completed work assigned to him and a cheque worth Rs. 3,50,000/- issued to him got bounced as the account was found closed and hence, the payment was not made.

It is submitted that admittedly, the informant is a petty contractor and to purchase some items, in case of exigency of the situation, cheques were issued to the informant, moreover,

Having considered the facts and circumstances, let the petitioner, named above, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Araria P.S.Case No. 308 of 2015; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
