Mr. AC to A.G ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 24-08-2020 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with Nawanagar (Sonbarsa) P.S. Case No. 42 of 2020 for the offence under Sections 377 of the Indian Penal Code and Section 4 of the POCSO Act.

Mr. Ajay Kumar Thakur, learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submits that the petitioner has been made accused due to previous enmity with his father and there is case between the parties i.e. the grand-father of the informant and late father of the petitioner. The petitioner is in custody since 17.02.2020.

Considering the nature of allegation levelled against the

Patna High Court CR. MISC. No.21118 of 2020(3) dt.24-08-2020 2/2 petitioner, the Court is not inclined to grant bail to the petitioner. Accordingly, his prayer for grant of bail is rejected. However, if the trial is not concluded within a period of six months, the petitioner may renew his prayer for bail.
