The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 341, 323, 307, 379, 427, 504 of the Indian Penal Code and 3(1) (x) of the S.C./S.T.(Prevention of Atrocities) Act.
Accusation is of abusing the informant by calling caste name and snatching Rs. 25,000/- from the pocket of the informant.
It is submitted by the learned counsel for the petitioners that for a petty dispute accusation has been
Patna High Court Cr.Misc. No.44730 of 2015 (3) dt.30-10-2015 levelled. The First Information Report was registered on 28.05.2014, but the case reached to the court of learned Additional Chief Judicial Magistrate on 30.05.2014. The brother of petitioner nos. 2 and 3 lodged Sonepur P.S. Case No. 205 of 2014 levelling accusation under Sections 147, 341, 323, 307, 379, 337, 427, 504 of the Indian Penal Code and 27 of the Arms Act against the informant's side on 28.05.2014 at 8.00 P.M. Hence, as retaliation the present case has been lodged.
Considering the nature of accusation and the case lodged by the petitioners'' side at the earlier point of time, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Sonepur P.S. Case No. 206 of 2014, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Dinesh Kumar Singh, J) P.K.
