Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Malaypur P.S. Case No.43 of 2016 registered under Sections 30(a) and 37(a) of the Bihar Excise (Amendment) Act, 2016.

The accusation is that on receiving secret information about selling of country made liquor by the petitioner in villageMalaypur Mahsonia, police reached near the house of the petitioner. On seeing the police, the petitioner started to flee away but was apprehended and on search, 110 pouches, each containing

Patna High Court Cr.Misc. No.52096 of 2016 (5) dt.26-04-2017 2/2 200 ml. country made liquor, concealed in the grass, were received near the house of the petitioner.

Learned counsel appearing on behalf of the petitioner submits that the petitioner has falsely been implicated in this case on mere suspicion and the petitioner, in the present case, is in custody since 05.10.2016. Further submission is that while the petitioner is accused in two other case, as detailed in paragraph-4 to the supplementary affidavit, but in that cases, the petitioner is on bail.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jamui, in connection with Malaypur P.S. Case No.43 of 2016.
