JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 18-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Jankinagar P.S. Case No. 149 of 2015, registered under Sections 406, 409, 420, 467, 468, 471 and 120B of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner, who was the then Block Development Officer, Banmakhi, has falsely been implicated in this case due to ulterior motive. In fact, in inquiry, it has come that the then Panchayat Secretary, Banmakhi, is responsible for committing irregularity in the distribution under "Indira Awash Yojena". It has only come in course of investigation that petitioner being the Block

Patna High Court Cr.Misc. No.5814 of 2017 (5) dt.18-04-2017 Development Officer, Banmakbhi, issued identity cards to some beneficiaries on the recommendation of the Panchayat Secretary. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea, in connection with Jankinagar P.S. Case No. 149 of 2015, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
