Mr. Abhay Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-07-2025 Heard learned counsel appearing on behalf of the petitioners and learned APP appearing on behalf of the State.
2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 304B and 34 of the Indian Penal Code.
3. It is a case of dowry death. As per prosecution case, marriage of daughter of informant was solemnized with coaccused Vikash Mistry in the year 2021 as per Hindu rites and rituals. It is alleged that after marriage, all the accused persons named in the F.I.R., including these petitioners, subjected daughter of informant to cruelty and harassment due to non-
Patna High Court CR. MISC. No.29803 of 2025(3) dt.01-07-2025 2/3 fulfillment of demand of dowry and later, they killed her.
4. It is submitted by learned counsel appearing on behalf of the petitioners that petitioners are quite innocent and have committed no offence. Petitioner No. 1 is married sister-inlaw of the deceased, Petitioner No. 2 is brother-in-law of husband of deceased and Petitioner No. 3 is brother of Petitioner No. 2 and they are victim of over implication. Petitioners are separate in mess and property and have got no concern with the affairs of the deceased and her husband. Thrust of accusation is against husband of deceased, who has already been granted bail by a Co-ordinate Bench of this Hon'ble Court vide order dated 15.03.2024 passed in Cr. Misc. No. 16371 of 2024. There are general and omnibus allegations and no specific allegation has been made against these petitioners. It is further submitted that earlier, informant had filed U.D.
Case No. 3 of 2022 prior to lodging of the present case before the Pauthu Police Station wherein he had clearly stated that his daughter was mentally disturbed and she tried to commit suicide but later on, this false and concocted case has been lodged. Petitioners claim clean antecedents.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the
Patna High Court CR. MISC. No.29803 of 2025(3) dt.01-07-2025 3/3 petitioners.
6. Considering the general and omnibus nature of accusation, fact that husband of the deceased has already been granted bail and clean antecedents of the petitioners, the prayer for grant of anticipatory bail to the petitioners is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Aurangabad in connection with Pauthu P.S. Case No. 70 of 2022, subject to condition as laid down under Section 482(2) of the B.N.S.S..
