The petitioner seeks bail in connection with Banka (Barahat) P.S. Case No.540 of 2018 registered under Sections 414/34 of the Indian Penal Code.
From the written report, four persons were arrested by the police and stolen motorcycles have been recovered from their possession. They disclosed before the police that the petitioner and Gurudeo Yadav are also involved in committing theft of motorcycle and at present one stolen motorcycle is in the house of the petitioner and accordingly police searched the house of petitioner and on search one Hero Honda Motorcycle without number was recovered from the house of petitioner and the petitioner disclosed that the recovered motorcycle is stolen

Learned counsel for the petitioner submits that the petitioner has purchased the second hand motorcycle and due to non-transfer of the aforesaid motorcycle, he was not having a paper. It is further submitted that the petitioner is in custody since 10.08.2018. He has no criminal antecedent. Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Banka (Barahat) P.S. Case No.540 of 2018. Both the bailors will be close relative of the petitioner.
