JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 394 and 302 of the Indian Penal Code.

Petitioner is not named in the First Information Report, but in course of investigation, the informant as well as wife of the deceased disclosed that there was land dispute between deceased and petitioner and it is alleged that prior to the alleged occurrence the petitioner had made attempt to assault the deceased. It appears that except the aforesaid circumstances, there is nothing against the petitioner who is languishing in jail custody since 20.03.2016 and against whom the investigation has already been completed.

Accordingly, the petitioner, above named, is directed

Patna High Court Cr.Misc. No.27438 of 2016 (3) dt.06-09-2016 2/2 to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Katihar in connection with Muffasil (Katihar) P.S.
