This is an application for grant of regular bail for offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(A) and 30(D) Bihar Prohibition Excise Act. It has been submitted on behalf of the petitioners that petitioners have been implicated in this case only on the basis of suspicion. Petitioners happen to be farmers and for feeding the cattle to prevent them from diseases in winter season, they were using the alleged recovered mahua and jaggery and had no intention to make wine. Petitioners have no criminal antecedent and they have been in judicial custody since 19.11.2016.
Patna High Court Cr.Misc. No.55212 of 2016 (2) dt.09-01-2017 2/2 Heard learned A.P.P. also.
Considering the facts and circumstances of the case, nature of offence and the period of custody, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate - Muzaffarpur, in connection with Ahiyapur P.S. Case No. 750 of 2016.
