JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 10-10-2022 Learned counsel for the petitioners is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioners as well as Mr. Lalan Kumar, the learned APP for the State.
The petitioners apprehend their arrest in connection with Masrakh P.S. Case No. 573 of 2020, registered for the offences punishable under Sections 452, 380, 341, 323, 324, 307 and 34 of the Indian Penal Code.
The present case has been registered on the basis of complaint petition. As per allegation, the accused persons entered into the house of the informant/complainant after breaking the back door of the house and they were taking boxes from his house. When
Patna High Court CR. MISC. No.22919 of 2022(2) dt.10-10-2022 2/2 the informant objected petitioner no. 1 ordered him to remain silent and the petitioners assaulted him with iron rod on his leg. Learned counsel for the petitioners has submitted that the petitioners are innocent. Both the parties are agnates. There is previous disputes between the parties regarding land and Masrakh P.S. Case No. 109 of 2018 has been lodged by the petitioners' side against the members of prosecution side and the petitioners are the persons of clean antecedent.
Considering the above-mentioned facts and circumstances, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Smt. Anupma, J.M. Ist Class, Saran at Chapra in connection with Masrakh P.S. Case No. 573 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
