JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-01-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 342, 323, 504, 379 and 506/34 of the Indian Penal Code. It is alleged that the informant purchased a tractor worth `5,61,000/- after getting financed from Mahindra & Mahindra Financial Services Ltd. The informant made payment of `2,44,503/- at the time of taking delivery of the tractor and he had to make payment of `3,50,000/- in 41 installments of `12,270/- each. The informant claims to have deposited balance amount in 18 months and when he asked for 'No Dues Certificate', he was assaulted and `7,200/- were snatched by the petitioners. It is submitted by learned counsel for the petitioners that due loan amount of ` 77610/- has still not been paid. A statement
Patna High Court Cr.Misc. No.3226 of 2015 (2) dt.23-01-2015 2/2 has been made in para 3 of the petition that the petitioners have no criminal antecedent.
Considering the accusation being levelled in the background of non-payment of loan amount, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sitamarhi in connection with Sitamarhi P.S. Case No. 724 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
