JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-11-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner apprehends his arrest in connection with Panapur P.S. Case No. 58 of 2020, registered under Sections 188 and 379 of the Indian Penal Code and Section 7 of the E.C. Act.

The accusation is that one Pickup van loaded with rice bags was seized by the police and in course of inquiry, it was detected that the same rice bags were belonging to Jitendra Sah of Village Bakwan, P.S. Panapur. Thereafter, police went at the house of Jitendra Sah then in front of house of Jitendra Sah at the door of Rabish Kumar Sah (petitioner), several empty bags of FCI recovered. Patna High Court CR. MISC. No.22245 of 2020(5) dt.11-11-2020 2/2 Sah (petitioner) was searched, from where, 150 to 200 rice bags of Kalash and other brands recovered. On query, Mamda Devi, wife of Rabish Kumar Sah(petitioner), did not produce the paper.

Learned counsel for the petitioner submits that petitioner is the businessman of rice and he has falsely been implicated in the present case mere on suspicion. Further submission is that petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Chapra, in connection with Panapur P.S. Case No. 58 of 2020, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
