This application for regular bail arises out of Rajpur P.S. Case No. 52 of 2020, disclosing offences punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act. The petitioners are in custody since 01.03.2020. It appears from the F.I.R. that three persons apprehended by the police including the petitioners, were found in possession of illegal Arms and Ammunitions. From the possession of petitioner no. 1, one live cartridge was recovered whereas from the possession of petitioner no. 2, one loaded country made pistol was recovered.
Learned counsel for the petitioners has submitted that
Patna High Court CR. MISC. No.21240 of 2020(2) dt.30-06-2020 2/2 the petitioners have no criminal antecedent and there is no allegation that the petitioners had used the said arms in their possession for any purpose, what so ever.
Considering the aforesaid submission, this application is allowed.
Let the petitioners above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-III, Buxar in connection with Rajpur P.S. Case No. 52 of 2020.
