The petitioner apprehends his arrest in a case registered for the offence under Section 308, 379 & other allied sections of the Indian Penal Code.

As per the prosecution case, this petitioner assaulted informant with iron rod causing injury on his head. It is submitted on behalf of petitioner that admittedly, there is land dispute between the parties and scuffle took place between the parties over possession of land. Injury caused by the petitioner is simple in nature.

However, learned A.P.P. for the State vehemently opposed the bail petition and submitted that there is direct and specific allegation against this petitioner of causing injury to informant, who sustained three injuries. He further submitted that petitioner has got criminal antecedent also and he is accused

Patna High Court CR. MISC. No.23421 of 2022(3) dt.10-11-2022 2/2 in four more cases.

Considering the nature of accusation, number of injuries caused by this petitioner and criminal antecedent of petitioner, the prayer for anticipatory bail of petitioner is rejected.
