ANJANA MISHRA ORAL ORDER 21-05-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is apprehending his arrest in connection with Barachatti P.S. Case No.235 of 2014 for allegedly having committed the offences under Sections 461 and 379/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the only allegation against the petitioner is that he had helped the person, who had committed theft of jewellery of the informant, to escape on the motorcycle. It is further submitted that there is no direct allegation of committing theft by this petitioner and as the petitioner is having business of jewellery close by to the shop of the informant that the petitioner has been roped in

Patna High Court Cr.Misc. No.51789 of 2014 (3) dt.21-05-2015 2/2 maliciously.

Considering the aforementioned submissions and also the fact that the petitioner has no criminal antecedents, let the above named petitioner, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Sherghati at Gaya, in connection with Barachatti P.S. Case No.235 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
