JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-12-2018 The petitioner seeks regular bail in connection with Dhansoi P.S. Case No. 08/2018, registered for offences punishable under Sections 302/34 of the Indian Penal Code. Allegation is that husband of the petitioner was going for walking near Kharwaniya Road and after one hour, informant received information that her husband has been shot dead by two miscreants.
It has been submitted on behalf of the petitioner that save and except suspicion raised by the informant that petitioner and co-accsued Dhanoj Sah had taken loan from the deceased and were not returning the same, there is nothing against the petitioner so as to show his involvement in the murder of the husband of the informant. No.73514 of 2018(2) dt.14-12-2018 2/2 submitted that co-accused Dhanoj Sah has already been enlarged on bail by a coordinate Bench of this Court vide order dated 04.12.2018 passed in Cr. Misc. No. 71179 of 2018 and petitioner has been in judicial custody since 27.09.2018. Heard learned A.P.P. also.
Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -III, Buxar, in connection with Dhansoi P.S. Case No. 08/2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
