This is an appeal under Sections 14(A)(2) against refusal of the prayer for anticipatory bail by order dated 30.06.2024 passed by the learned Exclusive Special Court, SC/ST Act, Patna in ABP No. 3227 of 2023 in connection with Khusrupr P.S. Case No. 86 of 2023, F.I.R. dated 09.03.2023 registered under Sections 323, 341, 504 and 34of the Indian Penal Code and Sections 3 (i) (r) (s) of the Scheduled Castes and Scheduled Tribes Act.
3. By the aforesaid order, the anticipatory bail petition of the petitioner was rejected by the Special Court.

4. Learned counsel for the respondent no. 2 has informed this Court that the petitioner has already approached in Cr. Misc. No. 49808 of 2023 (quashing) by which the Coordinate Bench of this Court vide order dated 31.07.2023 has been pleased to grant the relief to the petitioner "the petitioner shall not be arrested in connection with F.I.R. bearing Khusrupur P.S. No. 86 of 2023."
5. Learned counsel for the respondent no. 2 submits that in view of the aforesaid, the petitioner has no apprehension in the present case and he has filed the present case despite of knowing the fact that he is no apprehension of being arrest.
6. In view of the aforesaid, learned counsel for the appellant seeks permission to withdraw the appeal.
7. Permission is accorded.
