Petitioners are apprehending their arrest in Amdabad P.S. Case No. 67 of 2015 registered for the offences punishable under Sections 364/511 of the Indian Penal Code. The informant alleged that he is a witness in a case in Amdabad, P.S Case No. 26 of 2015, the petitioners had threatened him to depose in their favour that is why the petitioners tried to kidnap his son while the petitioners were kidnapping the son of the informant the villagers chased and recovered the victim. The petitioner fled away leaving his motorcycle and shoes on the spot. The informant has reiterated the same facts.

It is submitted that the petitioners have got several cases under excise Act and that is why the petitioners have falsely been implicated in the case at the instance of the S.H.O.

No.43586 of 2015 (3) dt.14-12-2015 2/2 From perusal of the records it appears that there is specific allegations against the petitioners that they kidnapped the son of the informant only because the informant did not depose in favour of the petitioners. I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly the same is rejected. The petitioner if so advised may surrender before the Court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail and his prayer shall be considered on its own merit without being prejudiced by this order.
