The petitioners apprehend their arrest in Samho P.S. Case No. 01 of 2017 instituted for the offence under Section (s) 448, 302, 504, 34 of the Indian Penal Code. As per written report, there is specific allegation against co-accused Babuchan Paswan of giving lathi blow on the head of the father of the informant who became senseless. The father of the informant was brought to the hospital for treatment and later on he died.
Learned counsel for the petitioners has pointed out the postmortem report which is annexed as Annexure-2,
Patna High Court Cr.Misc. No.14454 of 2017 (2) dt.28-03-2017 2/2 wherein the doctor has found only one injury on the parietal region of skull caused by hard and blunt substance on the person of the deceased. The petitioners are sons of Babuchan Paswan. There is general and omnibus allegation against these petitioners that they abused the father of the informant.
In the facts and circumstances of the case, the prayer of the petitioners for anticipatory bail is allowed. In the event of surrender/arrest of the petitioners, above named, within six weeks from today in connection with Samho P.S. Case No. 01 of 2017, they shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Begusarai, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
