The petitioner seeks regular bail in connection with Rajauli G.O. case no. 320 of 2018 (E 1074/18) registered for the offence punishable under Section 30(a), 56(b) of Bihar Prohibition and Excise Act, 2016.
The allegation is regarding the police having apprehended the vehicle from which 1200 ltrs. of illicit liquor was recovered. The petitioner is stated to be sitting in the said vehicle.
The learned counsel for the petitioner submits that the petitioner is neither the owner nor the driver of the said vehicle and was only a mere chance passenger who had taken lift in the said
Patna High Court Cr.Misc. No.72365 of 2018(2) dt.13-12-2018 2/2 vehicle. It is further submitted that the petitioner is having a clean antecedent and he is languishing in custody since 06.10.2018.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the abovenamed petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of A.D.J. II-cum-Special Judge, Nawada in connection with Rajauli G.O. case no. 320 of 2018 (E1074/18). (Mohit Kumar Shah, J) rinkee/- U T
