Petitioner seeks bail in a case registered for the offences punishable under Sections 392, 394 and 411 of the Indian Penal Code.

It appears that co-accused, Mithlesh Kumar having identical allegation has already been allowed bail by a coordinate Bench of this Court, vide Annexure 2. Petitioner is in custody since 23.03.2018.

Earlier prayer for bail was refused on 27.08.2018 in Criminal Miscellaneous No.36549 of 2018 with liberty to renew the prayer after completion of one year of custody, if the trial is not concluded within time.

The report of the learned trial judge would reveal

Patna High Court CR. MISC. No.73197 of 2018(3) dt.13-03-2019 2/2 that due to non-appearance of the co-accused on bail, the case has not been committed to the court of Sessions. Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Sonpur/Hajipur Rail Police Station Case No.23 of 2018, subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
