ANJANA MISHRA ORAL ORDER 17-11-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

Learned counsel for the petitioner is permitted to make necessary correction in paragraph No. 12 of the bail application. The petitioner is in custody since 09.10.2015 in connection with Ballia P.S. Case No. 316 of 2015, registered for the offence punishable under Section 394 of the Indian Penal Code.

Learned counsel for the petitioner submits that though the petitioner was remanded in connection with the present case having been implicated in Ballia P.S. Case No. 317 of 2015, but no T.I. Parade has yet been held even though the petitioner has been in custody for over a year. It is further submitted that the petitioner and the informant are well known to each other and the

Patna High Court Cr.Misc. No.40054 of 2016 (3) dt.17-11-2016 2/2 name of the petitioner has not been taken in the main F.I.R. It is further submitted that in the earlier case, the petitioner, who is a mechanic was found boarded on the motorcycle, which is alleged to have been looted one.

Considering the facts and circumstances of the case and the period of custody and also that the name of the petitioner has not been taken in the original F.I.R., let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in connection with Ballia P.S.
