====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 12-07-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307, 354(B), 447, 341, 379 and 385 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has antecedent of one case and he is alleged to have assaulted the informant's brother-in-law with kudal causing injury on his head. It is next submitted that petitioner has been falsely implicated in the present case, it is further submitted that there is a land dispute between the informant and the petitioner. No.23158 of 2023(2) dt.12-07-2023 2/3 submits that from perusal of the order impugned it would manifest that the informant along with the injured was present before the learned District Court when the anticipatory bail application of the petitioner was taken up and they made a categoric statement that the case has been compromised which also stands recorded in the order dated 1.02.2023 rejecting the anticipatory bail application of the petitioner. It is next submitted that when the informant and the injured on intervention of well wishers realizing their mistake are not willing to pursue the case against the petitioner and have compromised then no useful purpose would be served by sending the petitioner to jail. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the
