2. The petitioner seeks bail in a case registered for offence under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per F.I.R., the deceased was shot dead by two unknown miscreants and F.I.R. was lodged against unknown.
4. Name of the petitioner has surfaced during course of investigation in the confessional statement of co-accused Rinki Kumari, who has already been granted bail by this Court, vide order dated 14.12.2021 passed in Cr.Misc. No. 39513 of 2021 (Annexure P/2). Petitioner has been remanded in this case on 05.06.2021.
5. However, learned A.P.P. for the State vehemently
Patna High Court CR. MISC. No.25308 of 2024(2) dt.03-04-2024 2/2 opposes the prayer for bail and submits that during course of investigation, on verification of C.D.R. (call details record) of the deceased, it has come that this petitioner was in touch with the deceased. Several witnesses have also supported the prosecution case and there is sufficient materials in the case diary showing the involvement of the petitioner in the aforesaid crime. Besides this, petitioner is accused in ten more cases, out of which, some are of similar nature.
6. Considering the nature of accusation and criminal antecedent, the prayer for bail of petitioner is rejected. (Prabhat Kumar Singh, J) anay/- U T
