JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-11-2018 The petitioner seeks regular bail in connection with Amas P.S. Case No. 125 of 2018, registered for offences punishable under Sections 412 and 34 of the Indian Penal Code. Allegation as per F.I.R. is that some miscreants snatched Rs. 35 lacs from the employees of Toll Plaza and it is alleged that petitioner and others chased those miscreants and snatched away the looted amount and there is recovery of Rs. Two lacs from the petitioner.
It has been submitted on behalf of the petitioner that he has falsely been made accused in this case. Moreover, other co-accused having similar allegation has already been enlarged on bail by a coordinate Bench of this Court vide order dated 12.09.2018 passed in Cr. Misc. No. 42751 of 2018 and
Patna High Court Cr.Misc. No.68493 of 2018(2) dt.30-11-2018 2/2 petitioner has been in judicial custody since 27.05.2018. Heard learned A.P.P. also.
Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati, Gaya, in connection with Amas P.S. Case No. 125 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
