The petitioner is apprehending his arrest in connection with Danapur P.S.Case no.644 of 2018 , registered for offences punishable under Sections 420, 468, 120B of the Indian Penal Code and Section 63 of the Copy Right Act, 1957 and Section 103/104 of the Trade Marks Act, 1999.

FIR has been lodged by an Agent of Hero Company for selling fake mobil of his Company and the parts by some persons , on that information, the police raided the shop of the co-accused Shambhu Nath and Rakesh Kumar and recovered several articles and Shambhu Nath has disclosed that he has purchased the mobil from the shop of the petitioner. Submission of the learned counsel for the petitioner is

Patna High Court CR. MISC. No.22408 of 2019(2) dt.08-04-2019 2/2 that except confessional statement of the co-accused there is nothing against him and there is no recovery as well as he has no criminal antecedent.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM Ist, Danapur, Patna in connection with Danapur P.S.Case No.644 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure. With the aforesaid observation, this application is allowed.
