JUSTICE SUDHIR SINGH ORAL ORDER 08-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 376G of the Indian Penal Code and Sections 6/8 of POCSO Act.

Allegation against petitioner is of committing rape upon informant.

It has been submitted on behalf of petitioner that he is in custody since 30.9.2016. He has got no criminal antecedent. Chargesheet has been submitted against petitioner. No allegation of tampering of witnesses is alleged against petitioner. Petitioner has falsely been implicated in the present case. After investigation the police has submitted final form against petitioner vide Annexure-3 to the present application. Other co-accused has been granted bail vide Annexure-2 to the present application. On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond
