JUSTICE SUDHIR SINGH ORAL ORDER 28-11-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 341, 323, 504, 506, 376 and 511/34 of the I.P.C. Later on, Section 8 of the POCSO Act was added. Allegation against the petitioner is that he outraged the modesty of the daughter of the informant.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 27.7.2016 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The date of occurrence is 12.5.2016 whereas the case has been instituted on 10.6.2016. Delay has not been explained by the prosecution. Both the parties

Patna High Court Cr.Misc. No.50939 of 2016 (2) dt.28-11-2016 2/2 are agnates. The present case has been instituted due to property dispute.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge, Patna in connection with Special case No.95 of 2016 arising out of Shastri Nagar P.S. case No.259 of 2016.
