JUSTICE SHIVAJI PANDEY ORAL ORDER 06-11-2020 Heard learned counsel for the petitioner and learned counsel for the State through Video Conferencing. In this case, the petitioner is seeking regular bail in connection with Town (Begusarai) P.S. Case No. 139 of 2019 registered for offence punishable under section 30 (A) of the Bihar Prohibition and Excise Act.

A pick-up van was intercepted and from where 338 litres of illegal liquor has been recovered.

Learned counsel for the petitioner submits that the petitioner is owner of the said vehicle and he is in custody since 20.03.2020.

Looking to the period of custody, the petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the

Patna High Court CR. MISC. No.21993 of 2020(3) dt.06-11-2020 2/2 satisfaction of Additional Sessions Judge-II-cum-Special Judge (Excise Act), Begusarai in connection with Town (Begusarai) P.S. Case No. 139 of 2019, subject to the condition that one of the bailors of the petitioner shall be a close relative. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. If the petitioner is found in similar type of offence in future, the prosecution will be at liberty to file an application before the court below for cancellation of his bail.
