Heard the parties in virtual Court.
The petitioners are languishing in custody for the offence punishable under Sections 30(a) and 32(2) of Bihar Prohibition and Excise Amendment Act, 2018.
Allegation is of recovery of liquor. Petitioners have stated on oath that they have got no criminal antecedent. They are in custody since 27.02.2021. Investigation of the case is already complete.
Since this is the first allegation against the petitioners under Bihar Prohibition and Excise Act, let the petitioners,
Patna High Court CR. MISC. No.32101 of 2021(2) dt.29-10-2021 2/2 above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Banka (Barahat)P.S. Case No. 150 of 2021 (Special Excise Case No.154 of 2021), with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioners shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
(c) The petitioners shall not leave the country without permission of the trial Court.
