This application is for grant of anticipatory bail in connection with Ahiyapur P.S.Case No.229 of 2016 for the offence under Sections 341, 447, 323, 354, 307, 302 and 504/34 of the Indian Penal Code.

It is submitted on behalf of the petitioners that the only allegation against these petitioners is that they abused the informant and others. There is no other allegation against the petitioners and they have been falsely implicated in this case, due to the fact that they are 'Bataidar' of the informant. Heard learned A.P.P. and the learned counsel for the informant. The learned counsel for the informant has opposed the application for bail on the ground that there is an allegation that

No.4282 of 2017 (2) dt.09-02-2017 2/2 the accused persons had also assaulted the other injured, though there is no specific allegation that who has assaulted the injured but there are allegations against these petitioners. Having heard both sides. In view of the facts as stated above, I am not inclined to grant anticipatory bail to the petitioners, as such let the petitioners surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below on its own merit especially on the fact that there is no specific allegation against these petitioners and after considering the same, the application will be disposed of, if possible, on the same day.

With the aforesaid observation, this application is disposed of.
