The petitioner apprehends his arrest in Bahadurpur P.S. case No. 44 of 2019 registered under Section 30(a) of the Bihar Prohibition & Excise Act.

The informant, a police officer, alleged that he got information that one Maruti Suzuki van was going from Pandarsarai to Kharijpur. The vehicle was intercepted and 660 bottles of Royal Stag, each containing 375 ml, were recovered. The driver of the vehicle was not apprehended. The informant alleged that on secret information it transpired that Guddu @ Golu Jha and Rahul Jha, the petitioner, had brought the wine. Brother of Golu Jha is still in jail in connection with excise case. The learned counsel for the petitioner submits that petitioner has got no criminal antecedent and there nothing on

Save and except secret information received by the I.O., there is no material on record to show the involvement of the petitioner. Considering the facts aforesaid and nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-V-cum-Special Judge, Excise Act, Darbhanga in connection with Bahadurpur P.S. case No. 44 of 2019, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
